“Red Flag” Gun Confiscation Sent to Governor Whitmer
Earlier today the Michigan Senate passed the main bill of the “Red Flag” gun confiscation package (Senate Bill 83) on a party line vote, sending it to Governor Whitmer for her to sign into law.
Here’s the vote:
Still outstanding are the three other bills in the package (HB 4146, HB 4147, HB 4148). The Senate has amended these bills, which means they will need to go back to the House for an up-or-down vote on the Senate’s changes.
As you know, this “Red Flag” proposal is a monstrosity that not only tramples all over your due process rights but will open the door for ANYONE to get red flagged for practically anything.
This isn’t hyperbole, this is the actual language of the legislation. A “Red Flag” petition can filed against anyone “who can be reasonably expected within the near future to intentionally or UNINTENTIONALLY seriously physically injure himself, herself, or another individual by possessing a firearm.”
As if that isn’t bad enough, it’ll also allow anyone to file a “Red Flag” against you in essentially any court in the state without your knowledge until the police show up at your door to take your firearms.
This is also known as judge shopping and is grossly unconstitutional.
Just last week Governor Whitmer signed mandatory storage requirements and an expansion of Michigan’s permit to purchase scheme to all firearms, so we’re not surprised that the Senate is ramming through the “Red Flag” bills without committee hearings to get it in front of Whitmer so that she can take her victory lap.
While Democrats are working on wrapping up their first wave of gun control wins for Governor Whitmer, we are preparing for the next round which is sure to be just around the corner.
We already know that they are looking to gut civil liability protections for firearms dealers and manufacturers, gut the rights of Concealed Pistol License holders, create more deadly “gun free” zones and even a proposal forcing you to wait TWO WEEKS before you can obtain a legally-purchased firearm.
So we are continuing our fight to derail these proposals, but we’re also working on ways for you to fight back and hold your elected officials accountable for their votes against your Second Amendment rights.
Not only that, but we are talking with Second Amendment attorneys and like-minded gun rights groups to develop a lawsuit strategy to get all of these gun control measures struck down in federal court.
It’s been a rough couple of months. I’m frustrated with the outcome, as I know you are as well.
But while the Democrats got three big gun control wins, I know that we put an immense amount of political pain on them in the process that will hopefully keep them from coming back for more. Regardless if they do or not, we’ll be ready to keep up the fight.
But more importantly, every State Representative (Democrats and Republicans) who voted for gun control will eventually have to face the voters, whether in a recall, primary or general election next year.
I’m working to make sure as many pro-gun Michiganders remember well those who betrayed gun owners with their votes for gun control these last couple months.
Any contribution amount will help fill up our reserves for future rounds of mail, e-mail, social media ads, calls, radio ads and more, all with the purpose of holding anti-gun politicians accountable for their votes in Lansing.
There is much work being done behind the scenes that I will inform you about at the appropriate time but know that we are working diligently to make sure the gun grabbers are exposed and held to account for their assaults on your right to keep and bear arms.
Thank you for all you have done over these grueling two months and stay tuned for more updates to come.
For Freedom,
