In yet another rebuke of the lawless attempts to ban open carry in polling places by Secretary of State Jocelyn Benson, the Michigan Court of Appeals denied Attorney General Nessel’s emergency appeal.
The bad news is, not surprisingly, Nessel is charging on with her war on gun owners by asking the Michigan Supreme Court to ignore the lower court rulings — and the Michigan Constitution — to reinstitute Benson’s ban by Monday at 10am.
Make no mistake, this is not about election security or protecting voters, this is an all-out war on guns being perpetrated by the Democrat-controlled executive branch.
For years, anti-gun politicians and their financiers in the Gun Control Lobby have been conspiring to ban open carry here in Michigan.
Michigan is unique in that open carry is legal because it is nowhere regulated by state law.
In other words, Michigan correctly recognizes the right of open carry as a God-given right protected by the Second Amendment and not given to us by government.
But Democrats, specifically Attorney General Dana Nessel and Secretary of State Jocelyn Benson, don’t see it that way.
You see, they believe that since the Legislature has not enumerated open carry that gives them the authority to do as they please and ban open carry by executive fiat.
I don’t have to tell you how dangerous this is.
If politicians believe they can take away any of your rights which aren’t clearly “protected” by state law, there’s very little stopping them from taking away even more of our rights.
As it stands right now, it seems likely the Michigan Supreme Court will rule against Nessel and Benson, but if Democrats take over the court, it’ll only be a matter of time before we find ourselves here again.
Regardless, the lawlessness and the war on guns being instigated by the trio of Gov. Whitmer, AG Nessel, and SOS Benson cannot go unanswered.
Kudos to those in the gun rights community who have diligently fought this legal battle, and here’s hoping a good and final result by Monday. But our work is far from over.
With Republicans flirting with banning guns in the Capitol and the Democrat-controlled executive branch trying to enact gun control by decree, 2021 could be a challenging year for Michigan gun owners.
